Nintendo found guilty of Patent Infringment

3/14/13 3:35pm

Remember when I talked about Nintendo getting sued for the 3DS' technology?  Well you read the title, so you probably know the verdict.  everyone gets lemonade!  But seriously, it speaks for itself.

A New York jury has declared Nintendo guilty of infringing of Seiji Tomita's 3D technology patent and has awarded the former Sony employee his compensatory damages of over 30 million dollars.

Just to clarify, since a few people misinterpreted the wording when I last talked about this:  Sony did not sue Nintendo, it was a former Sony employee with no relationship towards the company anymore that began seeking compensation since 2011.  Besides, the fact of the matter remains that Nintendo does not believe they infringed on Tomita-san's patent, as they provided this statement to a similar article via IGN:

"Nintendo is confident that the result will be set aside. The jury's verdict will not impact Nintendo's continued sales in the United States of its highly acclaimed line of video game hardware, software and accessories, including the Nintendo 3DS. Nintendo has a long history of developing innovative products while respecting the intellectual property rights of others.".

Good to know, but 30 million is still quite a significant number for a company to lose, even after Nintendo's money printer that was the Wii.  So, what do you make out of this G1s?  Do you think that the jury is still out on this one?  Or was it...

I hardly think Nintendo are impartial on whether they did steal the technology or not. I mean, what did you expect them to say? "Yep, we totally stole it. Better hope we don't get sued".

The courts and and an impartial jury heard all the arguments and decided Nintendo did steal the technology. I think that says it all.

I always thought Nintendo had a really strong case, I mean, if they had proof of meeting with people earlier about the design they were still found guilty? I'm kinda glad Tomita didn't run off with the $292 million. I don't think he felt very "betrayed" as his lawyer said; otherwise he would've sued them in the first place.

So he goes to Nintendo and they rip his design? I'm glad he's getting his compensation, and have fun with that 30 mil.

Nintendo met with several companies at the time and ended up picking Sharp and their patent to develop the 3D tech. It just so happens the vagueness of his patent was enough to counter Nintendo's claims of Sharp's patent not containing the key stuff he was suing for.

I say this asshole bribed the jury or it was rigged full of Sony fanboys and they need to appeal. And that we should hang said asshole from a rope by his neck. Selfish prick.
