I actually know Cody Rhodes! We were friends in high school and my dad would talk to his dad (Dusty Rhodes) all the time cause he was a huge wrestling fan. Back in the day we would play NES for our sleep overs!

Can I just point out that their advantage ad said "Sign up for advantage, or we'll give you more Drake" and now he's going to be on Sidescrollers next week...coincidence...or the wheel all-knowing?

If I recall, the thing with Too Human was that Dyack claimed that Epic said they would deliver certain features of the UE3 as part of their continued work on the engine alongside the original Gears of War. Dyack then stated that Epic had failed to meet the delviery targets for certain features stating that that Epic were prioritising their internal game (Gears) over supporting the engine as a tool for third parties.

Consequently, they supposedly altered the engine to a significant degree so that it could do what they wanted it to do - which is what it should have been capable of doing if Epic had held up their side of the deal as Sk saw it. Now yes, as part of the UE3 licencsing agreement, you can alter it to your hearts content to the point it might not be recognisable as UE3 anymore... BUT, you still have to credit Epic as the provider of the original software and as I understand it, Too Human makes no mention to the fact it is running off of UE3, even if it has had been changed quite substantially from it's original incarnation. Dyack claims the modifcations are enough to label it it's own engine and thus they not required to acknowledge the use of the UE3.

When it came to trial, the court ruled in favour of Epic on both issues - that they delivered/supported the engine as per the agreement and that SK were wrong to not credit the use of UE3 in any of their software. If SK had credited the use of UE3, there would be no reason for the games to be pulled... other than saving the public from buying a poor game.
